Terms
The terms for using Houselist. Houselist is for businesses only.
Draft: this text has not been reviewed by a lawyer yet.
Who we are
Houselist is run by Modgift ApS, CVR DK46722779, Fenstenvej 10, DK-8300 Odder ("we"). You can write to us at [email protected].
The service
Houselist is a tool for music venues, festivals and promoters ("the client"). The client builds playlists, which we publish as real playlists on streaming services from Houselist’s own accounts, and which the audience can follow through a public page and a QR code.
Houselist never plays music. Playback happens in the listener’s own app, under that streaming service’s own terms.
Businesses only
Houselist is sold only to businesses. Consumer protection rules, such as the right of withdrawal, therefore don’t apply. Whoever creates an account confirms they may bind the client.
Account and sign-in
You create an account with your email address and sign in with a link or a code we send there. The client is responsible for who has access to that email address.
Prices and payment
- Drafts are free.
- Publishing needs an active plan: DKK 120 a month excl. VAT for 2 active playlists.
- Each add-on gives 2 more active playlists for DKK 40 a month excl. VAT.
- All prices are excl. VAT; Danish VAT of 25 % is added.
The plan is paid monthly in advance by card through our payment provider Frisbii. We may change prices with 30 days’ notice by email; the change applies from the first billing period after the notice.
If a payment fails, we try again. If the plan is still unpaid after 7 days, the client’s playlists are paused until the payment is sorted.
Cancelling
The client can cancel the plan at any time under "Your plan". The plan runs until the end of the period already paid for. Started periods are not refunded.
The client’s content
The client is responsible for its playlists, titles, descriptions, logo and images and must have the right to use them. Content must not be unlawful, offensive or misleading. We may hide or remove content that breaks these terms.
The client lets us show, store and publish the content as far as needed to provide the service, including on the streaming services.
Streaming services
Playlists are published from Houselist’s own accounts on the services Houselist supports. The services have their own terms and may change them, remove tracks or end access. We don’t guarantee that a given track is on a given service, or that a service stays supported.
Availability
We do our best to keep Houselist available, but can’t promise it will always run without interruptions or errors. We may have planned maintenance.
Liability
Our total liability to the client is limited to the amount the client paid for the last month before the claim arose. We are not liable for indirect losses such as lost revenue, lost profit or lost data, nor for the streaming services’ actions or errors.
If the terms are broken
If the client materially breaks these terms, we may close the account after written notice, or at once if needed to prevent harm.
Deleting the account and your data
The client can at any time download its data as a ZIP file and delete its account under "Your plan" and "Your venue". What is deleted, and what we must keep, is in the privacy policy.
Changes
We may change these terms with 30 days’ notice by email. If the client keeps using Houselist after the change, the new terms apply.
Governing law and venue
These terms are governed by Danish law. Disputes go to the Copenhagen City Court as the first instance.
